In fact, Texas has very generous state bankruptcy exemptions, which means that, in many cases, families can keep their homes. Furthermore, once a person files for bankruptcy, he or she receives what is called an automatic stay. This means that creditors stop calling and are unable to take further collection action.

In most cases, individuals can choose whether to file for Chapter 7 or Chapter 13 bankruptcy. Chapter 7 bankruptcy is generally known as a liquidation: a court-appointed trustee orders a sale of a person’s nonexempt assets to pay creditors as much as possible. Chapter 13 bankruptcy is generally known as a reorganization: filers agree to pay creditors over a three- or five-year period. In either situation, debt is wiped out after the process is complete.
